Nine out of 10 malpractice suits are handles outside of the court system. Once a lawsuit is put into motion, however, it becomes a part of public record regardless of whether it is actually taken to court. This gives anyone the right to see that they were sued for negligence of some sort and can work as a help for them in deciding whether to use their medical services or not. So don't worry if your doctor offers to settle outside of court, it will still be on his record and he won't be getting away with anything at all.
